چکیده:
مراجعه برای درمان و اعطای رضایت به پزشکان برای انجام مداخلات درمانی، پیروی از دستورات آنها توسط مجنیعلیه، گرچه قابل اجبار نیست، ولی در عرف و همچنین قواعد فقهی بهعنوان تکلیف بر مداوا یا امدادرسانی در نظر گرفته میشود و در صورت تأثیر چنین بیمبالاتی در تحقق نتیجه مرگ برحسب موضوع، به میزان تقصیر مجنیعلیه یا سایر افراد، از مسؤولیت کیفری مرتکب کاسته خواهد شد. این کاهش مسؤولیت صرفاً درخصوص جنایات شبه عمد یا شبه عمد تقصیرآمیزِ مرتکب نمیباشد، بلکه اگر مراجعه برای درمان و تکمیل مداخلات درمانی از طرف مجنیعلیه یا مرتکب درخصوص جراحتهای نوعاً کشنده قابل درمان صورت نگیرد، نوعاً کشنده محسوب نشده و قتل عمد محقق نخواهد گشت. از طرف دیگر ترک چنین وظیفهای تقصیر محسوب شده و به خاطر تأثیرگذاری در نتیجه، موجب غیرکشنده شدن رفتار ارتکابی خواهد شد و در شرایط مختلف و برحسب اوضاع و احوال واقع شده مسؤولیتهای مختلفی برای مرتکب و مجنیعلیه خواهد داشت. بنابراین بررسی مستقل جراحت وارده شده بدون مداقه در ویژگی مداواپذیری و میزان آن، تصویر شفافی از ماهیت حقیقی جنایت وارد شده ارائه نخواهد نمود و ممکن است به تشخیص اشتباه نوع جنایت در دادگاهها منجر گردد.
