چکیده:
مدیریت بینالمللی تنگههای بینالمللی در وضعیتهای خاص از منظر کنوانسیون حقوق دریاها از موضوعات مهم امروزی بینالمللی است. راهکارهای مدیریت تنگههای بینالمللی در وضعیتهای خاص هم در کنوانسیون حقوق دریاها و هم در خارج از مقررات کنوانسیون وجود دارد. کنوانسیون حقوق دریاها در ارتباط با مدیریت بینالمللی تنگههای بینالمللی در وضعیتهای خاص از قبیل قوه قهریه و جنگ، اصل را بر بقای حقوق مبتنی بر عبور بی ضرر و عبور ترانزیت میداند و اصولا در صورت حدوث وضعیت خاص، عبور بی ضرر و عبوز ترانزیت به قوت خود باقی میمانند. تأثیر وضعیتهای خاص بر مدیریت تنگههای بینالمللی است که در هیچ وضعیت خاصی، کشور مجاور تنگه حق مسدود کردن تنگه بینالمللی را ندارد و در صورت مسدود نمودن تنگه بینالمللی، برای کشور مسدود کننده مسئولیت بینالمللی ایجاد میگردد. در نهایت در وضعیتهای خاص بحرانی امکان تعلیق عبور به صورت موقت تا مرتفع شدن وضعیت خاص و انجام برخی از بازرسیها وجود دارد و مقررات کنوانسیون حقوق دریاها، اجازه ای بیش از این در وضعیتهای خاص را نمی دهد. از آنجا که وضعیتهای خاص، وضعیتهای موقتی هستند که مرتفع میگردند، کنوانسیون حقوق دریاها، همکاری و تشریک مساعی کشورهای مجاور تنگه و کشورهای عبوری را به عنوان راهکار اصلی مدیریت بینالمللی مطالبه میکند.

Finally, in certain critical situations, it is possible to temporarily suspend the passage until the special situation has been resolved and some inspections have been carried out, and the provisions of the Convention on the Law of the Sea do not allow further in certain situations. Because special situations are temporary situations that arise, the Convention on the Law of the Sea calls for the co-operation and co-operation of the countries adjacent to the Strait and the transit countries as the main strategy of international management.
