چکیده:
تمام نظامهای حقوقی خواهان تبعیت افراد از قوانین خود هستند اما افراد نیز برای چنین تبعیتی بدنبال یافتن دلایل متقاعد کنندهاند و وقتی بدلایل مختلف مرتکب نقض قوانین میگردند، عموماً (به باور خود) برای چنین اقدامی دلایل اخلاقی موجه و کافی دارند. پرسش این است که آیا تبعیت از قانون صرفاً دارای توجیه اخلاقی و غیراخلاقی بودن توجیه کننده عدم تبعیت است؟ پرسش اصلی این است که ماهیت دلایل تبعیت از قانون چیست؟ عموماً تصور میشود که حقوقدانان طبیعی برخلاف پوزیتویستها، بواسطه تاکیدشان بر ارتباط قوی میان اخلاق و قانون، ضرورتاً قائل به نظریه وجود دلایل یا تعهدات اخلاقی برای تبعیت از قانون هستند (نه قانونی). در این نوشتار ضمن انکار این تصور و مخالفت با ایده صرف وجود توجیه اخلاقی برای قانون و نیز عدم کفایت توجیه اخلاقی، بدنبال اثبات اتفاقنظر حقوقدانان طبیعی با پوزیتویستها در خصوص ماهیت این دلایل هستیم. لذا در ادامه دلایل عمومی باور به وجود تعهد اخلاقی به تبعیت از قانون، سپس تبیین رویکرد حقوقدانان طبیعی و پوزیتویست و در انتها اثبات ادعای عدم وجود تعهد اخلاقی صرف به تبعیت از قانون در حقوقی طبیعی مدرن تعقیب میشود.
Obviously, in all jurisdictions it is required for the people to observe the laws and regulations; however, at the same time they need to have convincing reasons to obey laws and regulation. Seeking their different interests, people sometimes may break laws. However, sometimes people believe that there are morally justifiable reasons to break laws. As a matter of fact, the research question of this paper is as follow: what is the nature of reasons that required people to observe the laws and regulations? Generally, natural lawyers stress on the strong relationships between law and morality and they stress on moral (Not legal) reasons. Despite that, as it will be shown, natural lawyers (Specially modern ones) and positivists have similar justification regarding the observing laws and regulations, in that both of them recognizing legal reasons for observing laws and regulations and denying the necessity and Sufficiency of moral reasons.
