چکیده:
سن کودک از جمله مسائل مهم و چالش برانگیزی است که امروزه کانون توجه حقوقدانان و حامیان حقوق کودک قرار گرفته است. مطابق ماده 1 کنوانسیون حقوق کودک مصوب 1989، 18 سالگی معیار بزرگسالی شناخته شده است. اما در فقه اسلامی ملاک اصلی برای ثبوت احکام و تکالیف، سن بلوغ میباشد و در حقوق موضوعه ایران نیز به تبعیت از فقه اثنی عشری، سن مسؤلیت مدنی و همچنین مسؤلیت کیفری، سن بلوغ دانسته شده است. عمده دلیل این تغایر میان قوانین داخلی و کنوانسیونها، التفات به عنصر بلوغ در فقه امامیه میباشد. مسأله حائز اهمیت این است که کاهش یا افزایش سن در تعیین «کودکی» چه آثاری را بر حقوق و تأمین مصالح کودک، بر جای خواهد گذاشت؟ همچنین، با عنایت به اینکه سن کودک در حقوق ایران متبع از فقه امامیه میباشد، چگونه می-توان بر خلاف آن عمل کرد و سن مذکور را منطبق بر مفاد کنوانسیونهای بین المللی دانست؟ بدین جهت در پژوهش حاضر سعی شده است تا امکان تبعیت از کنوانسیونهای بین المللی در تعیین سن کودک با توجه به امکان صدور احکام ثانویه و حکم حکومتی حاکم اسلامی در موارد تشخیص مصلحت، مورد بررسی قرار گیرد.
