چکیده:
رشد روزافزون فناوریهای نوین این امکانرا برای پرندههای هدایتپذیر از دور (زین پس پهپادها) فراهم میکند تاهرروز مناطق گستردهتری از حریمهوایی کشورها را درنوَردیده و البته در حوزههای مختلف مورد توجه و استفاده قرار بگیرند. بنابراین فعالیتهای پهپادی هردو جنبه غیرنظامی و نظامی را دربرمیگیرد. آنچه در این نوشتار مدنظر است، توجه بهجنبههای حقوقی هوانوردی پهپادهای غیرنظامی است. بهطور مشخص پرسش آن است که باتوجه به مقررات بینالمللی موجود قاعده-مندی پهپادها در صلاحیت ملی کشورهاست یا اینکه سازمانهواپیماییکشوریبینالمللی (ایکائو) میتواند در محدوده صلاحیت خود تنظیم کننده این قواعد باشد. ویژگیهای اجرایی متفاوت پهپادها از کاربران سنتی حریمهوایی و احتمال اجتناب ناپذیر ادغام عملیات هواپیماهای بدونسرنشین کنترل از راه دور در حریمهوایی تفکیک نشده و فرودگاهها در فاصله زمانی کوتاه، لزوم ضابطهمندسازی این پدیدههای نوین را مشخص میسازد. ماده ۸ کنوانسیون شیکاگو(1944) به هواپیماهای بدون خلبان توجه داشته، لیکن مقررات این کنوانسیون در خصوص قاعدهمندی پهپادها فراتر از این نرفته است. از اینرو باتوجه به برخی ابهامات و کاستیها در مقررات کنوانسیون شیکاگو و نیز ویژگیهای عملکردی پهپادها لازم است تا جامعهجهانی برای انتظام بخشیدن به نظام حقوقی پهپادها بپذیرد که آیا واقعاً پرواز این پرندهها باید در صلاحیت نظام داخلی دولتها باشد یا اینکه ایکائو میتواند بهعنوان مرکزی جهت هماهنگکردن و قاعدهمندسازی موضوعات مرتبط با هواپیماهای بدونسرنشین در نظام جامعهجهانی گام برداشته و حقوق را نه به پیشی گرفتن اما همگامی با تکنولوژی وادارد.

They operate in various social and economic fields, commercial, agricultural, environmental, military, security, etc. Therefore, UAV activities include both civilian and military aspects. What is considered this article is to pay attention to the legal aspects of civil UAV aviation. Specifically, whether the regulation of UAVs is within the national jurisdiction of the countries, or whether the International Civil Aviation Organization (ICAO) can regulate their activities within its jurisdiction. Since the different performance characteristics of UAVs from other aircraft and the inevitable possibility of integrating remote control UAVs operations in unsegregated airspace and airports in a short period, the need to regulate them are in urgent. Article 8 of the Chicago Convention (1944) pays attention to pilotless aircraft, however, the situation of UAVs in this convention is vague. Therefore, due to some ambiguities and shortcomings as well as the functional characteristics of UAVs, it is necessary to enquire whether the flight of UAVs should be under the jurisdiction of the domestic system of States or that ICAO can take steps to coordinate and regularize issues related to UAVs which is the main core of this article.
