چکیده:
در نظام حقوقی ایران، برنامههای توسعه اقتصادی، اجتماعی و فرهنگی در قالب «قانون» و به صورت برنامههایی پنجساله تهیه میشوند. علیرغم مفروض بودن سه ویژگی «برنامهای بودن»، «موقتی و زمانمند بودن» و «در راستای نیل به اهداف و سیاستهای توسعه اقتصادی و اجتماعی بودن» برای این دسته از قوانین، بررسی محتوای این دسته از قوانین گویای آن است که بخش قابل توجهی از مفاد این قوانین، هیچگونه تناسبی با تمام یا بخشی از ویژگیهای ذکر شده ندارد. در قالب پژوهشی توصیفی – تحلیلی، ضمن آسیبشناسی محتوای قوانین برنامهی پنجساله توسعه این نتیجه به دست آمد که نگاه نمایندگان مجلس به قوانین برنامه به عنوان بستری مناسب برای تقنین هر موضوعی است که مورد انتظارشان است و این عامل سبب بروز برخی ناهنجاریها در حوزهی قانونگذاری شده و به انضباط قانونگذاری خدشه وارد کرده است. لذا، قانونگذاری به منظور «تأسیس سازمان یا تشکیلات دائمی»، «اصلاح قوانین عادی»، «پیشبینی حقوق و تکالیف برای شهروندان» و «اصلاح نقش یا صلاحیت نهادها و مراجع قانونی» باید در قوانین مربوط به خودشان صورت گیرد.. از سوی دیگر، شورای نگهبان میبایست در فرآیند نظارت بر قانونگذاری بر رعایت ویژگیهای قوانین برنامه توسعه، نظارت دقیقتر و سختگیرانهتری داشته باشد تا بتوان انتظار داشت که قوانین برنامه پنجساله توسعه به جایگاه واقعی خودشان در نظام حقوقی کشور برسند.
In the Iranian legal system, economic, social, and cultural development plans are prepared in the form of “law” and in the form of five-year plans. Despite the assumption of three characteristics of ”being planned”, “being temporary and timely” and “being in line” with the goals and policies of economic and social development for this group of laws, examining the content of this group of laws shows that a significant part from the provisions of these rules, it has no relation to all or part of the mentioned features. In the form of descriptive-analytical research, while pathology of the content of the five-year development plan laws, it was concluded that the view of parliamentarians on the program laws as a suitable platform for legislating any issue that is expected of them and this factor has caused some anomalies in legislation and has undermined legislative discipline. Therefore, legislation in order to “establish a permanent organization or organization”, “amend ordinary laws”, “provide for the rights and duties of citizens” and “reform the role or competence of legal institutions and authorities” should be done in their own laws.
