چکیده:
کارفرما در قراردادی که با پیمانکار منعقد مینماید عموما جبران کلیه خسارات ناشی از حوادث کار را به عهده پیمانکار مینهد. این موضوع نه تنها در قراردادهای مذکور رواج عرفی یافته است بلکه در برخی مقررات مانند شرایط عمومی پیمان نیز مورد اشاره واقع شده است. با این وجود رویه قضایی و دکترین حقوقی موضع واحدی در خصوص انتقال مسئولیت در این خصوص ندارد. برخی با استناد به اصل نسبی بودن قراردادها، ابراء مالم یجب، امری بودن قواعد مسئولیت و ارتباط ناگسستنی آن با نظم عمومی به ویژه در مواردی که حادثه ناشی از کار در حوزه حقوق کیفری قرار میگیرد و نیز حفظ حقوق حادثه دیده، توافق طرفین در انتقال مسئولیت را بیاثر دانسته و مسئولیت کارفرما را تابع قواعد تقصیر میدانند. حال آنکه به نظر برخی دیگر این توافق به دلایلی نظیر اصل آزادی قراردادها، اصل قابلیت انتساب قرارداد در برابر اشخاص ثالث، قیاس با عاقله و ضمان جریره موثر بوده و میتواند منجر به برائت کارفرما از مسئولیت شود. در داوری بین این دو دیدگاه میتوان با استناد به واقعیات عملی قراردادهای پیمانکاری، طریق اولویت و جلوگیری از طرح دعاوی متعدد در محاکم، دیدگاه دوم را در انطباق بیشتر با اصول حقوقی و احترام به اراده افراد دانست.
