چکیده:
نظریه امور غیرقابل پیشبینی و اعمال آن در قراردادهای اداری، با هدف انطباق قرارداد با خواست طرفین و ضرورتهای اجتماعی و اقتصادی صورت میگیرد. بهطور کلی در نوشتههای حقوقی سه روش اجرایی برای تعدیل و انطباق قرارداد معرفی میشود که عبارتند از: تعلیق و تأخیر اجرای قرارداد (در صورتی که وقایع حادث موقتی، و انجام تعهد و زمان انجام آن دارای تعدد مطلوب باشد)، کاهش میزان تعهد گزاف و یا افزایش میزان تعهد طرف مقابل (بهعنوان شیوه غالب در انطباق قراردادهای اداری) و در نهایت، حکم به پرداخت خسارت (بر مبنای مسئولیت غیرقراردادی که به دلیل ایرادات وارد بر مبنای مزبور، در نوشتار حاضر شیوه پرداخت خسارت بر مبنای الزام همکاری متعاقدین منتج از اصل حسن نیت، پیشنهاد میگردد). لیکن نتیجه حدوث امور غیر قابل پیشبینی ممکن است صرفاً پرهزینه کردن اجرای قرارداد نباشد، بلکه برعکس، منجر به جلب سود گردد. سودی که از یک سو حاصل از اجرای قرارداد تلاش مشترک متعاقدین بوده، لیکن از سوی دیگر، فقط عاید یکی از آنها میشود. در حالت اخیر نیز همانطور که در رأی دادگاه تجدیدنظر نانسی (بهطور غیر مستقیم) مورد حکم قرار میگیرد، نظریه امور غیر قابل پیشبینی در تقسیم سود حاصل از تغییرات حادث به عنوان روشی نوظهور از انطباق قرارداد ظاهر میگردد. بنابراین در نوشته حاضر و با مراجعه به منابع مربوط و به صورت تحلیلی- توصیفی، ضمن پاسخ به مسأله تأثیر امور غیر قابل پیشبینی در قراردادهای اداری در قالب انطباق قرارداد، شیوههای چنین انطباقی مورد تحلیل قرار گرفته است.
The theory of unpredictable affairs and its application in administrative contracts is done with the aim of adapting the contract to the wishes of the parties and social and economic necessities. In the latter case, too, the theory of the unpredictable has the potential to provide a solution and, as the Nancy Court of Appeal ruled (indirectly), in the distribution of profits. Incidental changes appear and are proposed as an emerging method of contract compliance.
