چکیده:
آنچه در مجازات جرائم اعم از حدی و غیر حدی تحقق پیدا میکند ناظر به جنسیت نیست و جنس جرم بدون لحاظ جنسیت مجرم قابلیت طرح دارد لکن پس از تأمل در متون فقهی و حقوق موضوعه ایران در مجازات حدی قتل تفاوتهایی جنسیتی در میزان مجازات ونیز نحوه اعمال آن به چشم میخورد که محل تأمل و تحلیل این نوشتار است. از منظر فقه و حقوق، قاعده کلی بر این پایه استوار است که جنسیت زنان تأثیری در ادله اثبات و مسئولیت کیفری آنان نداشته و ذاتاً سبب تخفیف یا تشدید این نوع مسئولیت در باب قانونگذاری و مجازات نمیشود بنابراین زنان همانند مردان در مجازات کیفری یکسان میباشند؛ اما در موضوع مجازات و کیفرهایی از قبیل قتل، جنسیت میتواند تأثیر گذار باشد. قانونگذار با در نظر گرفتن جنسیت زن و یا مرد در جرم مشخص و یا مشترک میزان و کمیت مجازات را در زمان تصویب، تعیین کرده که نسبت به جنسی شدیدتر و بیشتر نسبت به دیگری خفیفتر و کمتر باشد. در این نوشتار تأثیر جنسیت زنان در مجازات قتل مورد بررسی قرارگرفته و به تفکیک به موارد تخفیف و تفاوت مقررات و مجازات مردان و زنان پرداختهشده است.
