چکیده:
موضوع مسئولیت مدنی ناشی از ارتباطات اینترنتی در بر گیرنده ی نقض حریم خصوصی، حق بر فراموش شدن، جرایم احتمالی ناشی از ارتباطات اینترنتی، نقض حقوق شهروندی و بسیاری از خسارات جانی، مالی و معنوی است که تحقق مسئولیت مدنی در گرو احراز ارکان آن همچون ورود ضرر، فعل زیانبار و رابطه ی سببیت است. بنابراین بدون تحقق هر یک از ارکان پیش گفته نمی توان ضمان را مترتب دانست. از جهاتی مطالبه ی ضرر و شیوه های ارزیابی ضرر معنوی ناشی از ارتباطات اینترنتی نیز می تواند یکی از مسائل مهمی باشد که متأسفانه در این خصوص رویه ی واحدی وجود ندارد. در نتیجه ارکان مسئولیت مدنی ناشی از ارتباطات اینترنتی در اتحادیه اروپا بر خلاف حقوق ایران، دارای ارکان دیگری همچون قابلیت پیش بینی بودن ضرر است و ضرر معنوی و مادی در حقوق ایران و اتحادیه اروپا قابل جبران بوده و شیوه های جبران خسارت در ضرر مادی به صورت مثلی و قیمی و در ضرر معنوی نیز به شیوه هایی که دادگاه تعیین می نماید قابلیت جبران خواهد داشت. به طور کلی در مقاله ی حاضر با توجه به مطالعات کتابخانه ای و اهمیت نحوه ی مطالبه ی خسارت و قواعد و اصول حاکم بر این نوع مسئولیت در حقوق ایران و اتحادیه اروپا می توان عنوان نمود که قوانین و مقررات موجود در این زمینه در حقوق ایران بر خلاف اتحادیه اروپا جامع و کامل نمی باشد.

As a result, the pillars of civil liability arising from internet communications in the EU, contrary to Iranian law, have other pillars such as predictability of damage and moral and material damage in Iranian and EU law can be compensated and methods of compensation for material damage to The form of guardianship and in case of moral damage will be compensable in the ways determined by the court. In general, in the present article, considering the library studies and the importance of how to claim damages and the rules and principles governing this type of liability in Iranian and EU law, it can be stated that the existing laws and regulations in this field in Iranian law. Unlike the European Union, it is not comprehensive.
