چکیده:
زمینه و هدف: قضاوت به حق میتواند ظلمی را بردارد و قضاوت به ناحق ظلمی را ایجاد کند. لذا قانونگذار در کنار قضاوت، عنصر دیگری تعبیه کرده تا خسارت ناشی از قضاوت به ناحق را جبران نماید. بررسی این امر از اهداف این تحقیق است.
مواد و روشها: این پژوهش از نوع نظری و بنیادی بوده و روش انجام آن اسنادی و کتابخانهای میباشد.
ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.
یافتهها: مقنن نه قاضی را چنان مسؤول کرده که عملاً به تعطیلی قضا بیانجامد و یا قاضی جسارت و شهامت قضاوت را از دست بدهد و نه چنان مصون قرار داده که به سهل انگاری و بیتوجهی کشیده شود. لذا در برخی از موارد جبران خسارت و ضرر را بر عهده خود قاضی قرار داده و در برخی موارد، حکومت و بیتالمال را مسؤول جبران خسارت قرار داده است.
نتیجهگیری: نتایج پژوهش نشان داد که اگر خسارت وارده توسط قاضی، ناشی از تقصیر عمدی یا غیرعمدی و تخلف ولی مغایر با ضوابط قانونی باشد، شخصاً ضامن جبران خسارت وارده مادی و معنوی بوده که در صورت حیات قاضی با یکی از راهکارهای ترمیم عینی (حالت قبل از وقوع جرم) اعاده وضع، جبران مالی، هتک حیثیت، عودت آبرو افراد به حالت سابق و لزوم پرداخت غرامت باید ضرر وارده را جبران نماید. امّا پس از مرگ قاضی، خسارت از ترکه یا میراث وی جبران میگردد. اما درصورتیکه قاضی در صدور رأی اشتباه یا خطا کند و بدون هیچ سوء نیتی حکم ناصواب صادر نماید، خسارت از بیتالمال پرداخت خواهد شد.
Background and Aim: Judging rightly can remove oppression and unjust judgment can create oppression. Therefore, in addition to judging, the legislator has installed another element to compensate the damage caused by unjust judgment. Investigating this is one of the goals of this research.
Materials and Methods: This research has been carried out in a library using descriptive-analytical research methods.
Ethical Considerations: Ethical considerations related to writing texts and referring to sources was observed.
Findings: The legislature has not made the judge so responsible as to effectively lead to the closure of the judiciary or the judge to lose the courage and bravery of the judiciary, nor has it made him so immune as to be drawn into negligence and carelessness. Therefore, in some cases, the judge is responsible for compensating the damage and in some cases, the government and the treasury is responsible for compensating.
Conclusion: The results of the study showed that if the damage caused by the judge is due to intentional or unintentional fault and violation but contrary to legal rules, he is personally responsible of compensation for material and moral damage. If the judge is alive, he should compensate the damage with one of the objective remediation measures like financial compensation. However, after the judge's death, the damage will be compensated from his estate or inheritance. However, if the judge makes a mistake or error in issuing a verdict and issues an incorrect verdict without any malice, the damages will be paid from the treasury.
