چکیده:
قوانین موضوعه با توجه به نتایج و بازخوردهای حاصله در جامعه و نیز شرایط فرهنگی کشور به بازنگری و اصلاح نیاز دارند تا ضمن ممانعت از تراکم قوانین ناکارآمد، دادگستری را نیز از مواجهه با حجم انبوهی از دعاوی متنوع رهایی بخشیده و بیشترین کارآمدی را برای این نهاد به ارمغان آورند. وجود یک مجلس قانونگذاری جامع، متشکل از متخصصین و نخبگان کشور میتواند مسیر دستیابی به نتیجهی مطلوب را هموار نماید. از دیگر اولویتهای اصلاحی، لحاظ نمودن سن کمال عقلی و تجربهی حقوقی قبلی در استخدام متقاضیان منصب قضاء و اصلاح مقررات گزینش شخصیتی و تصویب قوانین به روز و برخاسته از آموزههای اسلامی میباشد که به نوبهی خود میتواند موجب جذب شایستهترین افراد دارای صفات بارز اخلاقی و علمی در منصب قضاء و عملکرد بهینهی دادگستری شود. در این میان توجه به این نکته ضروری مینماید که قضات فاقد این ویژگیها برای ترمیم وضعیت خود ممکن است از ابزارهای حقوقی نوین، نه به عنوان یک تدبیر قضائی بلکه در مسیری نادرست، بهره جویند که در چنین حالتی به دلیل اینکه عملکرد قضائی آنان پشتوانهی علمی ندارد لذا مطلوب نیز نخواهد بود و آنچه حاصل میشود فعلی تصنعی و غیر اصیل است که منجر به وهن تصمیمات و آراء قضائی میگردد. بنا بر آنچه مطرح شد این مقاله سعی داشته است با محور قرار دادن قضات به عنوان رکن اصلی و تصمیمساز در دعاوی مطروحه در دادگستری، اهمیت توجه به اصلاح مقررات استخدامی و گزینشی آنان و ضرورت ارتقاء کیفیت قانونگذاری را مورد بررسی قرار دهد.
AbstractStatutory laws need to be revised and amended based on cultural requirements and social consequences and feedback in order to prevent the increase of inefficient laws, reduce the great number of various cases and improve and optimize the efficiency of the judiciary. The existence of an exclusive legislative assembly consisting of professionals and elites can facilitate reaching qualified results. The other amendatory priorities in selecting the most qualified judges and improving the judiciary could be including the “wisdom age” and prior legal experience of judiciary position candidates, revising the laws regarding the personality selection of prime candidates, and enacting up-to-date laws based on Islamic teachings. It is worth mentioning that the less qualified judges may make use of some modern tools improperly to compensate for their inferiorities, which is of no benefit as their legal actions lack scientific background. Therefore, the result would be inauthentic and spurious actions leading to the degradation of judicial decisions. Having been said, considering the fundamental role of judges in ongoing cases in the judiciary, this article is an attempt to investigate the significance of revising the employment and selection rules, and the necessity of improving the quality of legislation.
