چکیده:
نظام سیاسی حاکم بر جمهوری اسلامی ایران، ویژگیهای خاصی دارد که در بین نظامهای سیاسی موجود در جهان، منحصربه فرد است. بارزترین ویژگی این نظام، ابتنای آن بر اصل ولایت فقیه است. فارغ از همه بحثهایی که در ارتباط با این نظریه مطرح شده، یک موضوع مهم، آن است که آیا در فرضی که این اصل، جوهره نظام سیاسی جمهوری اسلامی را تشکیل میدهد و تمام شئون این نظام بر اساس این اصل استوار میگردد، کدام یک از مدلهای سنتی نظامهای سیاسی یعنی ریاستی یا پارلمانی یا نیمه ریاستی- نیمه پارلمانی در جمهوری اسلامی قابل شناسایی هستند؟ این سوال میتواند در کنار سوال دیگری مطرح شود و آن اینکه اساسا نظام سیاسی فعلی در ایران، ریاستی است یا پارلمانی یا نیمه ریاستی- نیمه پارلمانی؟. در پاسخ میتوان گفت بر اساس آنچه در قانون اساسی مذکور شده، نظام سیاسی حاکم بر ایران، ریاستی است و نه پارلمانی. اما سوالی که شاید از هر دو مهم تر باشد و این نوشتار، قصد ارائه پاسخ به آن دارد، این است که آیا در فرض استقرار و ابتنای نظام سیاسی بر اصل ولایت فقیه، میتوان از تغییر حاکمیت در ایران از ریاستی به پارلمانی سخن گفت یا خیر؟ به عقیده نگارندگان این امکان وجود دارد و چه بسا در فرض تغییر نظام سیاسی ایران از ریاستی به پارلمانی، کارکردهای این نظام ارتقا یافته و بیشتر به سمت «کارآمدی» آن پیش برود.
Political systems in a traditional division are called the presidential system, the parliamentary system and the semi-presidential system (or semi-parliamentary system). Each of these political systems has its own characteristics and functions. At the same time, they suffer from some disadvantages, so that political theorists and public law have emerged as the ones who offer new solutions and models. The current political system that rules Iran, the Islamic Republic, in itself, has certain characteristics that are unique among the political systems in the world. . The most prominent feature of this political system is its basis on the principle of Velayat-e-Faqih as a model of governance and the political theory of Islam. Regardless of all the controversy surrounding this theory, An important issue to consider is whether, assuming that this principle constitutes the essence of the political system of the Islamic Republic and that all aspects of this system are based on this principle, which of the traditional models of political systems is the presidency or Can they be recognized as parliamentary or semi-presidential (semi-parliamentary) in the Islamic Republic?
