چکیده:
این پژوهش با هدف واکاوی قوانین و مقررات خاص استخدامی قضات در دو مبحث ورود به خدمت و خروج از خدمت و تطبیق آن با قوانین استخدامی عام و لایحه جامع اداری و استخدامی کارکنان قوه قضاییه انجام شد. سوال اصلی تحقیق، این است که حقوق استخدامی قضات در دو مقوله یادشده، تا چه حد با قوانین استخدام کشوری و قانون مدیریت خدمات کشوری شباهت و تفاوت دارد؟ نیز اینکه این مهم در لایحه چه تحولاتی داشته که بتواند تدبیر این لایحه را توجیه کند. بر این اساس، در مبحث ورود به خدمت، موضوعات انواع استخدام، شرایط استخدام، گزینش (ضوابط و مراحل)؛ و در مبحث خروج از خدمت، موضوعات استعفا، اخراج، بازخرید و بازنشستگی بررسی و تطبیق داده شد. نتیجه آنکه در مجموع، تفاوت چندانی میان ورود به خدمت قضات و کارمندان در مباحث حالات استخدامی و گزینش نیست و لایحه نیز، نوآوری در این زمینه نداشته ودر اکثر مواقع به تکرار قوانین خاص قضات پرداخته است. در بحث خروج از خدمت نیز، هم نوآوری نداشته و به تکرار پرداخته است. لذا پیشنهاد میشود به جای تصویب لایحهای با مفاد تکراری و تورم قوانین، حقوق استخدامی قضات هم به قانون مدیریت خدمات کشوری ارجاع شود و برای موارد خاص آنها میتوان فصلی را به این قانون اضافه نمود. چه اینکه استقلال قضات بیشتر از انکه به حقوق استخدامی انها ارتباط داشته باشد، میبایست با بیطرفی و استقلال دادگاه و قاضی، عدم مداخله همه ارکان حکومت در امر قضاوت و از طریق اعمال قواعد دادرسی منصفانه اعمال شود
Since the Judiciary Principles Act of 1911, judges have had special employment rules for any reason, including the status of judicial independence, and have been excluded from general employment laws and regulations. According to the National Employment Law approved in 1966, judges are excluded from the scope of this law and are subject to it only in the absence of special rules. This was also stipulated in Article 117 of the Civil Service Management Law. But to what extent has this particular regulation differed from the general employment law in the last 110 years, and to what extent has this distinction justified justification for more than a century? The aim of the study was to analyze the specific employment rules and regulations of judges in the field of entry into service and its compliance with general employment laws, and the topics of entry into service, types of employment and its general conditions were analyzed and applied. The result is that judges differ from staff in not anticipating contract employment, the possibility of exemption from military service, the maximum length of probation, the need for inherent citizenship and productive purity.
