چکیده:
حق، ادعایی معنـادار، منطقـی و موجهشدنی در گستره انسان و به دست آمده در راستای منزلت و شرافت او است. در این میان، حق در طیفی از نظریات مختلف، متفاوت و گاه متعارض فهم شده است. این اندیشههای فقهی، بسته به پارادایمهایی که عموما از آن سخن گفته نشده، مفهوم حق را از جنس فروتر یا والاتر با حکم دانستهاند. بنابراین مساله تحقیق پیشرو، تحلیل علل و عوامل تحولات عارض بر فهم فقها از حق است. در حقیقت، رویکرد فتوایی در فقه (به معنای عام)-به عنوان هویتی کاملا شکلیافته و رایج- که معیار درستی را مبتنی بر "حجیت" و پیمایش طریق سنتی و فنی در اتم گزارههای فقهی (: موضوع و حکم) میداند، شان فتوا را متوجه معنایی از حق میداند که گرچه عمدتا مفهومی ایستا است ولی متاثر از پارادایمهای متعددی است؛ همچون: معنای انسان، پیشفهمها به نصوص (نظیر عقلانیت گزارهای، مقاصد، گستره انتظار از دین و..)، فطرت، جعل استقلالی حق و نیز امکان خلو واقعه از حکم. این نوشته مبتنی بر مطالعات توصیفی-تحلیلی و کتابخانهای به شناسایی زمینهها و تاثیر آنها بر تفاوت فهم از حق میپردازد.
