چکیده:
زمینه و هدف: یکی از وظایف مهم افراد در جامعه اسلامی، دستگیری نیازمندان و تهیدستان میباشد هر کس به اندازه امکانات و توانمندی خویش وظیفه دارد که خلاءهای موجود در زندگی افراد را جبران و کمبودهای آنان را در حد توان رفع کند.
مواد و روشها: این تحقیق از نوع نظری بوده روش تحقیق به صورت توصیفی تحلیلی میباشد و روش جمعآوری اطلاعات به صورت کتابخانهای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.
ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.
یافتهها: فقیهان بزرگ شیعه و برخی از طوایف اهل سنّت به این امر فتوا داده و گفتهاند: زن بالغ رشید برای هرگونه تصرفی در اموال خود مجاز است، خواه شوهر داشته باشد یا نداشته باشد.
نتیجهگیری: زن نیز همانند مرد شایستگی مالکیت و اداره اموال خود را دارد و میتواند نسبت به اموال و املاکی که از طریق کار و تلاش اقتصادی یا ارث یا مهر و نفقه، مالک شده است، هرگونه تصرفی از قبیل خرید و فروش، اجاره، رهن، مزارعه، مساقات، هبه صلح، مضاربه و قرض داشته باشد و نیاز به اجازه گرفتن از کسی، حتی از شوهر، ندارد.
Background and Aim: one on of the most important duties of the people in Islamic societies is helping needies and indigents. Every one had to compensate the existing shortages of the others depending on her hisown possibilities. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Findings: Shia important jurisprudences and some of the Sonnet tribes had accepted this and they have said: Adult women can decide to do everything with her own properties, either she has husband or not. Conclusion: Women, like men, can run her own properties which had acquired by economic working, inheritance, dower and alimony, women can decide what to do with their own properties such as buying and selling, leasing, mortgaging, farm letting, donation, bailment and loaning and they do not need to let anyone even their husband.
