چکیده:
حقوق کودک، به عنوان بخشی از مباحث حقوق بشر، بر حمایت و پشتیبانی از کودکان و دستیابی آنان به حقوق اساسی خویش اهتمام دارد. حقوق بشر، حقوق ذاتی همه انسانها میباشد. کودکان نیز به طور یکسان و بدون تبعیض صاحب این حقوق هستند. هدف اصلی این پژوهش بررسی حق بر آموزش کودکان و بررسی آن در اسناد بینالمللی است. برای دستیابی به این هدف از روش تحلیلی بهره گرفته شده است. مبنای اصلی این تحلیل، کنوانسیون حقوق کودک به عنوان مهمترین سند خاص در حوزه حقوق کودک، بندهای مرتبط این کنوانسیون در ارتباط با حق آموزش کودک، دیگر اسناد بینالمللی حقوق بشر، جایگاه آموزش در نظام حقوق بشر بینالملل، اعلامیه حقوق بشر و اعلامیه حقوق بشر اسلامی میباشد، لذا به رسمیتشناختن حق بر آموزش کودکان در نظام حقوق بشر، لزوم حمایت و تعهد دولتها در دسترسی کودکان به امکانات آموزشی مناسب را در پی خواهد داشت. اعلامیه حقوق کودک دربردارنده مفهوم گستردهای از کودک به عنوان صاحبان حق میباشد. چهار اصل اساسی کنوانسیون حقوق کودک را میتوان: 1ـ اصل عدم تبعیض و تضمین حقوق مندرج در کنوانسیون برای همه کودکان، بدون هر نوع تبعیض؛ 2ـ در اولویت قرارگرفتن منافع و علائق کودک در هر قانون و مقرراتی که بر کودک تاثیر میگذارد؛ 3ـ حق زندگی، بقا و رشد کودکان و نوجوانان؛ 4ـ حق ارائه نظر و عقیده کودکان در کلیه مراحل تصمیمگیری که به آنها مربوط میشود. این سند بینالمللی، ضمن مواد 28 و 29 حق آموزش را در کودکان به رسمیت میشناسد و این حق بر اساس فرصتهای برابر تبیین شده است. از دیگر اسناد بینالمللی حقوق بشر، اعلامیه حقوق بشر 1948 میباشد. ماده 26 آن، حق بر آموزش کودکان را به رسمیت میشناسد. همچنین آموزش را هدایت شخصیت انسانی با حسن تفاهم، گذشت و احترام به عقاید مختلف میداند. این تحلیل، از یکسو، معرف اعتقاد به کرامت ذاتی کودکان و قائلشدن «شخصیت انسانی»، بدون هرگونه تبعیض بر محوریت موضوعات؛ جنسیت، رنگ، عقیده، قومیت و مذهب و سایر ویژگیها میباشد؛ از سوی دیگر، تاکید بر اصل حمایت از کودکان و شناسایی حقوق بنیادین آنها میباشد. حق بر آموزش به عنوان یک اصل حقوق بشر، در حوزه کودکان شامل حقوقی، از جمله حق دسترسی به امکانات آموزشی، حق برخورداری از آموزش با کیفیت و استاندارد، احترام به شان و منزلت انسانی کودک، آموزش بدون تبعیض در تمام مراحل دوران کودکی، در دسترسبودن امکانات آموزشی و برابری فرصتها در آموزش میباشد.
Children's rights, as part of the human rights debate, focus on protecting and supporting children and achieving their basic rights. Human rights are the inherent rights of all human beings. Children also have the same rights without discrimination. The main purpose of this research is to investigate the right to education of children and to study it in international documents. An analytical approach has been used to achieve this goal. The main focus of this analysis is the Convention on the Rights of the Child as the most important document in the field of child rights, related articles on the Child’s education right, other international human rights instruments, the position of education in the international human rights system, the Declaration of Human Rights and Islamic Declaration of Human Rights. Therefore, recognizing the right to education for children in the human rights system will require the support and commitment of governments to provide children with access to appropriate educational facilities. The Declaration of the Rights of the Child incorporates the broad concept of the child as the right holder. The four basic principles of the Convention on the Rights of the Child can be: 1. The principle of non-discrimination and the guarantee of the rights of the Convention for all children without any discrimination; 2. The priority of the interests of the child in any law and regulations affecting the child; 3. The right to life, survival and development of children and adolescents; 4. The right to have children's views and opinions at all stages of their decision-making. In this international instrument, Articles 28 and 29 recognize the right to education in children and this right has been enshrined in equal opportunities. Another international human rights instrument, especially in the field of children and the right to education of children, is the Human Rights Declaration of 1948. Article 26 recognizes the right to education of children and everyone has the right to equal access to education and access. It also sees education as guiding the human personality with good understanding, forgiveness and respect for different beliefs. This analysis, on the one hand, represents the belief in the inherent dignity of children and the "human personality" without any discrimination on the basis of issues of gender, color, opinion, ethnicity and religion, and on the other hand, emphasizes the principle is to protect children and to recognize their fundamental rights. The right to education as a human rights principle in the field of children, including the right to access to education, the right to quality and standard education, respect for the human dignity and dignity of the child, non-discrimination education at all stages of childhood, access to educational opportunities and equality of opportunity in education.

ميثاق بين المللي حقوق اقتصادي، اجتماعي و فرهنگي، مصوب ١٦ دسامبر ١٩٦٦ مجمع عمومي سازمان ملل متحد ( ICESCR: International Covenant on Economic, Social and Cultural Rights) از جمله مهم ترين اسناد بين المللي در حمايت از حقوق بشر است که حق دسترسي همگان به آموزش و پرورش را به رسميت شناخته است .
بيانيه کنفرانس سازمان هاي آموزشي ، علمي و فرهنگي ١٩٧٦ سازمان ملل General Conference of the United Nations Educational, Scientific and ) Cultural Organization)، دسترسي به آموزش و پرورش ، در چارچوب تعليم و تربيت مادام العمر را يکي از جنبه هاي اساسي از حق آموزش و پرورش و تسهيل در استفاده از حق مشارکت در زندگي سياسي ، فرهنگي ، هنري و علمي ميداند و مضافاً اين که سواد آموزي را به عنوان يک عامل مهم در توسعه سياسي و اقتصادي ، پيشرفت فناوري و تحولات اجتماعي و فرهنگي در نظر ميگيرد.
در واقع بررسي حق آموزش کودکان در کنوانسيون حقوق کودک ( CRC: Convention on the Rights of the Child) و گسترش آن در چارچوب حقوق بشر بين المللي مورد توجه خواهد بود.
