چکیده:
اصول 77 و 125 قانون اساسی جمهوری اسلامی ایران در مقام تبیین جایگاه موافقت نامه های بین المللی و تعیین صلاحیت قوای مقننه و مجریه در فرایند انعقاد آن هاست. با وجود نگارش کتاب ها و مقالات متعدد در زمینه ی حقوق معاهدات و صلاحیت های قانونی نهادهای حکومتی در این زمینه، همچنان نقاط ابهام فراوانی در خصوص صلاحیت مجلس شورای اسلامی در تصویب موافقت نامه های بین المللی مانند امکان سنجی تصویب معاهدات بین المللی در قالب طرح نمایندگان مجلس، صلاحیت مجلس در خصوص تعهدات داوطلبانه، صلاحیت مجلس در تصویب موافقت نامه هایی تحت سایر عناوین مندرج در اصول 77 و 125 و صلاحیت شورای عالی امنیت ملی در تصویب موافقت نامه های بین المللی وجود دارد؛ که تحلیل و بررسی آن ها از منظر حقوقی ضروری به نظر می رسد. از همین رو سوال اصلی پژوهش حاضر عبارت از اینکه حدود صلاحیت های مجلس شورای اسلامی در تصویب موافقت نامه های بین المللی چیست؟ این مقاله با رویکرد تحلیلی و بهره گیری از روش کتابخانه ای به دنبال پاسخگویی به پرسش مطرح شده است. به نظر می رسد صلاحیت تصویب همه ی موافقت نامه های بین المللی که دارای وصف بین المللی اند و موجب ایجاد تعهد برای جمهوری اسلامی ایران می شوند، انحصارا در اختیار مجلس شورای اسلامی است و عنوان معاهده و همچنین قید داوطلبانه بودن در آن را نمی توان مانعی بر صلاحیت مجلس تلقی کرد. همچنین برای مجلس شورای اسلامی حق ورود در جزییات معاهدات وجود دارد.
Principles 77 and 125 of the Constitution of the Islamic Republic of Iran are supposed to clarify the stance of international agreements and to determine the competence of the legislative and executive powers in their conclusion process. Despite written books and numerous articles in the field of the law of treaties and legal competencies of governmental institutions in this area، there are already many ambiguities regarding the competence of the Islamic Consultative Assembly in approving international agreements which are necessary to analyze them from a legal perspective; such as the feasibility of approving them in the form of legal proposals of representatives، the competence of the assembly regarding the voluntary commitments، its competence in approving agreements under the other titles set forth in Principles 77 and 125 and also، the competence of the of Supreme National Security Council in approving international agreements. Hence، the main question of this research is to determine the competencies of the Islamic Consultative Assembly in approving international agreements. This article seeks to answer that question with an analytic approach and using the library method.
It seems that the approval authority for all of international agreements having international description and making a commitment to the Islamic Republic of Iran is exclusively at the disposal of the Islamic Consultative Assembly and the title of the treaty and also being voluntary aren’t obstacles for the assembly’s authority. The Islamic Consultative Assembly is also allowed to review the details of the treaties.
