چکیده:
زمینه و هدف: اقدامات متقابل جزء مهم ترین مباحث مطرح شده در رابطه با مسئولیت بین المللی دولت ها است که مواد 49 تا 53 از پیش نویس مسئولیت بین المللی ناشی از رفتار متخلفانه دولت ها (مصوب سال 2001 کمیسیون حقوق بین الملل) را به خود اختصاص داده است. کمیسیون حقوق بین الملل طی مواد مذکور به هدف، محدوده، شرایط و سایر مسائل مربوط به اقدامات متقابل پرداخته است. حملات سایبری به عنوان یکی از جلوه های نوین مداخلات سایبری مورد شناسایی قرارگرفته است. با توجه به اینکه این حملات سایبری مصداقی از توسل به زور و مداخله در امور داخلی دولت محسوب می شود، سوال اصلی در بحث اقدامات متقابل آن است که در صورت وقوع یک حمله سایبری که نقض تعهد توسط یک دولت محسوب می شود، چه اقداماتی توسط دولت زیان دیده می تواند به عنوان اقدامات متقابل صورت پذیرد؟ آیا این اقدامات صرفا توسط دولت زیان دیده به طور مستقیم باید انجام شود، یا از طرف دولت-های ثالث نیز امکان پذیر خواهد بود؟ آیا مداخله سایر کشورها صلح و امنیت بین المللی را تهدید نمی کند؟
روش تحقیق: شیوه پژوهش حاضر مبتنی بر روش توصیفی-تحلیلی و استفاده از منابع کتابخانه ای است.
یافته ها: اقدام متقابل دربرگیرنده اقدامات غیرخصمانه ای است که به خودی خود غیرقانونی است؛ اما زمانی که دولت زیا ن دیده در پاسخ به فعل متخلفانه دولت مسئول به این اقدامات مبادرت می ورزد، جنبه غیرقانونی آن زایل می شود.
نتیجه گیری: هدف اقدام متقابل، حمایت از خود، واداشتن دولت مسئول به پیروی از تعهداتش و جبران خسارت دولت زیان دیده است. اقدام متقابل در رویه قضایی موردپذیرش قرارگرفته است؛ علی رغم این پذیرش، هنوز توافق زیادی در رابطه با نقش و جایگاه اقدام متقابل صورت نگرفته است.
Setting and Purpose: Mutual actions are one of the most important issues put in connection with the international duties of governments، which the articles 49 and 53 in the draft of international duty taken from the offensive acts of governments، have been allocated to international taw commission، according to the aforesaid articles، has addressed the goal، limit، circumstances and other matter related to mutual actions. Cyber attacks have been recognized as one of the new parades of cyber interferences. Considering the fact that cyber attacks are rated as evidence of resort to force and cyber interferences، the main question in discussing mutual actions is [what should a lost government do as mutual actions، if a cyber attack known as the breach of commitment by a government? Are the actions directly taken by the lost government or possible to be taken by other governments. does the interference of other countries threaten international peace and security.
Research method: The present research is conducted based on descriptive analytical method and the use of library sources.
Findings: Mutual action includes non-hostile actions which are illegal per se; however، when a lost government takes these actions in response to the wrong doing of a responsible government، its illegal aspect is disappears.
Conclusion: The goals of mutual action are self-support، assigning a government to follow its commitments and making up for the loss of the lost government. Mutual action has been accepted in judicial procedure; In spite of this acceptance، there has been no agreement in connection with the role and the status of mutual action.
