Abstract:
زمینه: کشور ایران از تعداد زیادی ذخایر بزرگ نفت و گاز مشترک با کشورهایی مانند عراق، امارت و عمان بهره مند است که جهت توسعه و بهره برداری از این میادین مشترک، نیازمند عقد قراردادهایی برای اکتشاف، توسعه و تولید در این میادین هستیم. این پژوهش ، به دنبال طراحی مدل موفق و اقتصادی جهت قراردادهای ساخت در حوزه نفت و گاز در میادین مشترک و مرزی است که در آنها بر اصول اخلاق زیست محیطی نیز توجه ویژه شده باشد . روش: پژوهش حاضر بر اساس هدف، کاربردی و از نظر نحوه گردآوری دادهها، از نوع تحقیقات کیفی میباشد. جامعه آماری خبرگان قراردادهای ساخت در حوزه نفت و گاز ایران بود که با روش نظری و هدفمند (گلوله برفی) 35 نفر از آنها به عنوان نمونه انتخاب شدند. ابزار جمعآوری دادهها مصاحبه نیمه ساختار یافته بوده و و تحلیل داده ها با تکنیک تحلیل تم انجام شد. یافته ها: 35 شاخص در قالب 6 مؤلفه(اقتصادی، قانونی، سیاسی و بین المللی، اخلاق زیست محیطی، فنی و نیروی انسانی) به عنوان عوامل موثر در قراردادهای ساخت در میادین مشترک طبقه بندی و مدل تحقیق تنظیم شد. نتیجه گیری : نتایج تحقیق نشان داد که برای صیانت از مخازن نفت و گاز کشور می بایست در قراردادهای ساخت ضمن در نظر گرفتن مولفه های سیاسی و بین المللی ، اقتصادی، قانونی، فنی و نیروی انسانی ، منافع ملی و نیازهای نسل آینده مورد توجه قرار گیرد و اهمیت اخلاق زیست محیطی در قراردادها لحاظ گردد.
Background: Iran benefits from a large number of large oil and gas reserves shared with countries such as Iraq, UAE and Oman, and in order to develop and exploit these common fields, we need to conclude contracts for exploration, development and production in these fields. This research seeks to design a successful and economic model for construction contracts in the field of oil and gas in joint and border fields, in which special attention is paid to the principles of environmental ethics.
Method: The current research is applied based on its purpose and qualitative research in terms of the method of data collection. The statistical population was experts in construction contracts in Iran's oil and gas field, and 35 of them were selected as a sample using a theoretical and targeted method (snowball). The data collection tool was a semi-structured interview and the data analysis was done using the theme analysis technique.
Findings: 35 indicators in the form of 6 components (economic, legal, political and international, environmental ethics, technical and manpower) were set as effective factors in construction contracts in the common fields of classification and research model.
Conclusion: The results of the research showed that in order to protect the country's oil and gas reservoirs, it is necessary to take into account the political and international, economic, legal, technical and manpower components, national interests and the needs of the future generation in the construction contracts. and the importance of environmental ethics should be considered in contracts.
