Abstract:
ارتباط حقوق با زیست فناوری در این سوال آشکار میشود که چگونه میتوان راهحلهایی را برای پاسخ به چالشهای ناظر بر زیست فناوری مطرح نمود. با توجه به رویکردهای قانونگذاری مختلف در سطح ملی و وجود خلاءهای حقوق بینالملل معاهداتی، اتخاذ رویکرد حقوق بشر محور در قاعدهمندسازی کاربردهای زیست فناوری دارای اهمیت ویژهای است. این پژوهش به کمک روش تحلیلی-تطبیقی درصدد است تا چالشهای ناظر بر کاربردهای زیست فناوری را از منظر حق بر سلامت مورد بررسی قرار دهد. مسئله این است که کاربردهای زیست فناوری تا چه میزان به تحقق حق بر سلامت کمک میکند و آیا حمایت از حق بر سلامت ظرفیت ارائه الگوی هنجارسازی مطلوبی در پاسخ به چالشهای زیست فناوری را دارد یا خیر. در میان کاربردهای این فناوری، چالشهایی در سطح بنیادی، هنجاری و ساختاری مطرح است. فرضیه پژوهش نشان میدهد که تقویت مکانیسمهای حمایتی از حق بر سلامت در سطح ملی و بینالمللی میتواند الگوی مطلوبی جهت قاعدهمندسازی متحدالشکل در پاسخ به چالشهای زیست فناوری که با سلامت انسان در ارتباط است؛ ارائه نماید
Abstract The relationship of law and biotechnology becomes clear if we know how to find solutions to the challenges of biotechnology. Given the various legislative approaches at the national level and the existence of international treaty law gaps, the adoption of a human rights-based approach in regulating the application of biotechnology is of particular importance. Using comparative analytical methods, this study seeks to address the challenges of biotechnology applications from a right to health perspective. The question is to what extent biotechnology applications contribute to the realization of the right to health and whether the protection of the right to health has the capacity to provide a favorable normative model in response to the challenges of biotechnology. Among the applications of this technology are fundamental, normative and structural challenges. The research hypothesis suggests that reinforcing the right to health protection mechanisms at the national and international levels could provide a suitable model for uniform regulation in response to biotech challenges related to human health.
